DESENVOLVIMENTO DO CONCEITO DE SANÇÃO NA TEORIA POSITIVISTA: DE KELSEN À BOBBIO
Analisa a importância da sanção na escola positivista, destacando o seu tratamento na estrutura da norma contida na Teoria Pura do Direito idealizada por Kelsen, traçando um paralelo com o Estado liberal, para em seguida confrontar com a compreensão de Bobbio, que analisa a sanção a partir de sua função no ordenamento jurídico, conferindo uma maior importância à sanção positiva, até então ignorada pela maioria dos filósofos do direito. O estudo da sanção a partir destes autores nos permite traçar claramente a forma como o instituto da sanção evoluiu na escola positivista, adequando-se ao Estado Social contemporâneo.

Abstract:
This essay analyze the importance of the sanction in the positivist school, highlighting its treatment in the norm’s structure contained in the Pure Theory of Law idealized by Kelsen, drawing a parallel with the liberal State, then confronting with Bobbio's understanding, which analyzes the sanction from its function in the juridical order, giving a greater importance to the positive sanction. The study of the sanction from these authors allows us to clearly trace the way of the institute of sanction has evolved in the positivist school, adapting itself to the contemporary wellfare state.
