DECISÕES JUDICIAIS COLEGIADAS NO ÂMBITO DO TRIBUNAL DE JUSTIÇA: ANÁLISE À LUZ DA MEDICINA BASEADA EM EVIDÊNCIAS
Introdução: Atualmente, a saúde tem um lugar de importância também nas questões de direitos sociais da população, que são garantidos por meio de políticas sociais e econômicas. Tal fato só foi possível graças à previsão desse direito na Constituição Federal. Entretanto, apesar da expressa previsão constitucional da saúde como direito de todos e dever do Estado, é perceptível que sua completa efetivação ainda não foi plenamente realizada, o que acarreta a judicialização do direito à saúde. Objetivo: Analisar as decisões colegiadas no âmbito do Tribunal de Justiça à luz da Medicina Baseada em Evidências. Método: Estudo documental, descritivo, com base no sítio eletrônico do Tribunal de Justiça do Estado de Minas, por meio da pesquisa do descritor “pirfenidona” no campo relativo à jurisprudência, julgados entre 2011 e 2020. Resultados: Em aproximadamente 86% dos casos analisados, os acórdãos desconsideraram a fundamentação técnico-científica representada pelo relatório da Comissão Nacional de Incorporação de Tecnologias e determinaram o fornecimento do fármaco ao requerente com base, apenas, em fundamentos técnico-jurídicos, a partir de atestados e relatórios do médico que acompanha o requerente. Conclusão: Os relatórios da CONITEC deveriam preponderar quando da tomada de decisões judiciais relativas a fornecimento de medicamentos, tendo em vista haver expressa determinação legal nesse sentido e por se tratar de documento produzido com base em evidências científicas e com a participação de vários expoentes da área de saúde. Decisões em desacordo com tais relatórios tem impacto negativo na política pública de fornecimento de medicamentos, na medida em que aumentam o custo do sistema sem o devido apoio em evidências científicas.

Abstract:
Introduction: Currently, health also has an important place in the population's social rights issues, which are guaranteed through social and economic policies. This fact was only possible thanks to the provision of this right in the Federal Constitution. However, despite the express constitutional provision of health as a right for all and a duty of the State, it is noticeable that its complete implementation has not yet been fully carried out, which leads to the judicialization of the right to health. Objective: To analyze collegiate decisions within the scope of the Court of Justice in the light of Evidence-Based Medicine. Method: Documentary, descriptive study, based on the website of the Court of Justice of the State of Minas, through the search of the descriptor "pirfenidone" in the field related to jurisprudence, judged between 2011 and 2020. Results: In approximately 86% of cases analyzed, the judgments disregarded the technical-scientific basis represented by the report of the National Commission for the Incorporation of Technologies (NCIT) and determined the supply of the drug to the applicant based only on technical-legal grounds, from certificates and reports of the doctor accompanying the applicant. Conclusion: NCIT reports should prevail when making judicial decisions regarding the supply of medicines, given that there is an express legal determination in this regard and because it is a document produced based on scientific evidence and with the participation of several exponents of the area of health. Decisions in disagreement with these reports have a negative impact on public policy on drug supply, as they increase the cost of the system without due support in scientific evidence.
