DECISÃO JUDICIAL: UMA ANÁLISE LINGUÍSTICA-DISCURSIVA DE UM CASO DE VIOLÊNCIA DOMÉSTICA NO RIO DE JANEIRO
RESUMO: Neste trabalho, buscamos analisar, a partir da perspectiva da Análise de Discurso Crítica e a Linguística Sistêmico Funcional, uma sentença judicial proferida na Comarca do Rio de Janeiro, no I Juizado, de violência contra a mulher. Compreende-se que a questão da neutralidade e imparcialidade se faz presente no cotidiano dos operadores de direito, principalmente, por questão de legalidade e Justiça. Entretanto, os sujeitos não estão isentos de valores, crenças e ideologias. As escolhas linguísticas revelam-nos a percepção de mundo dos sujeitos que interagem em um determinado contexto comunicativo. Desta forma, pretende-se analisar e refletir a representação da magistrada acerca do caso de violência doméstica. Para respaldar o trabalho, utilizamos os estudos da gramática sistêmico funcional em Língua portuguesa (FUZER; CABRAL, 2014), a abordagem de discurso como prática social (FAIRCLOGH, 2001) e os estudos de gênero discursivo (MARCUSCHI, 2003). Assim, constatamos que a representação manifestada no texto da magistrada refere-se à preocupação pelos direitos das mulheres na sociedade e, principalmente, pontua o papel do Estado no combate à violência contra a mulher.

Abstract:
In this work, we analyze, from the perspective of Critical Discourse Analysis and Systemic Functional Linguistics, a judicial sentence handed down in the District of Rio de Janeiro, in the First Court, of violence against women. It is understood that the issue of neutrality and impartiality is present in the daily life of law enforcement officers, mainly for reasons of legality and justice. However, the subjects are not exempt from values, beliefs and ideologies. The linguistic choices reveal to us the perception of the world of the subjects who interact in a determined communicative context. Thus, it is intended to analyze and reflect the representation of the magistrate about the case of domestic violence. To support this work, we used the studies of systemic functional grammar in Portuguese (FUZER; CABRAL, 2014), the approach of discourse as a social practice (FAIRCLOGH, 2001), and the studies of discursive genre (MARCUSCHI, 2003). Thus, we note that the representation expressed in the magistrate's text refers to the concern for women's rights in society, that is, the role of the State in combating violence against women.
