DECISÃO JUDICIAL: SEUS REQUISITOS E SUA RELEVÂNCIA JURÍDICA
Primeiramente aborda-se as definições e conceitos da Decisão Judicial, sua função, os princípios que a norteiam e como deve ser estruturada de acordo com as normas vigentes. A Decisão Judicial possui grande relevância jurídica pois é a efetivação dos direitos das partes, por meio deste ato praticado pelo magistrado. A construção de seu corpo é sistêmica e visa a clareza do que foi decidido, pois trata-se de decisão que possui força no mundo jurídico, dessa maneira as exigências contidas neste conjunto decisional, por assim dizer, devem ser precisas. A interpretação deve ser realizada de forma primorosa a fim de extrair das fontes do direito o embasamento técnico e teórico. Além desta, o ato jurisdicional carece de argumentação adequada, e de fundamentação para unir os pontos aduzidos, trazendo a justificação do uso de determinadas matérias e normas no teor da decisão. A força jurídica dessa decisão possui efeito erga omnes, enfatizando a publicidade nela existente. Além disso coloca em voga, os princípios, e aparatos legais que a norteiam e outros essenciais para que a decisão seja efetiva e válida no mundo jurídico. Outrossim esses entendimentos que o juiz precisa prestar em sua decisão nada mais são que a ação do Estado em sua função jurisdicional, protegendo direitos ou consolidando-os a fim de regular a sociedade e os conflitos nela existentes. E ainda se vislumbra a importância adicionada a ideia de que a decisão concebe novas formas de ver o Direito de maneira prática, por uma perspectiva normativa diferente da observada no corpo normativo. Espera-se que cada vez mais o Direito sirva de norte para a sociedade resolvendo as divergências e econômicas e sociais da melhor maneira. É sabido que há muito tempo o Direito tem corrido atrás da sociedade regulamentando novos direito e deveres, posteriormente. E a construção racional de uma decisão irá transpor essas barreiras que impedem o aperfeiçoamento jurídico dos Órgãos Jurisdicionais.

Abstract:
Firstly, the definitions and concepts of the judicial decision, its function, the principles that guide it and how it should be structured in accordance with the prevailing rules are addressed. The Judicial Decision has great legal relevance because it is the enforcement of the rights of the parties, through this act practiced by the magistrate. The construction of his body is systemic and aims at clarity of what has been decided, since it is a decision that has strength in the legal world, so the requirements contained in this decision set, as it were, must be precise. Interpretation must be performed exquisitely in order to draw from the sources of law the technical and theoretical basis. In addition, the judicial act lacks adequate reasoning and reasoning to unite the points raised, justifying the use of certain matters and rules in the content of the decision. The legal force of this decision has an erga omnes effect, emphasizing the publicity therein. It also puts into practice the principles and legal apparatus that guide it and other essentials for the decision to be effective and valid in the legal world. Moreover, these understandings that the judge must give in his decision are nothing more than the action of the State in its jurisdictional function, protecting rights or consolidating them in order to regulate society and the conflicts that exist in it. And we can see the added importance of the idea that the decision conceives new ways of seeing the Law in a practical way, from a normative perspective different from that observed in the normative body. Increasingly, the law is expected to serve as a guide for society in resolving economic and social divergences in the best way. It is well known that law has long been chasing society regulating new rights and duties afterwards. And the rational construction of a decision will overcome these barriers that hinder the legal improvement of our forums and courts.
