DAS RELAÇÕES NEGOCIAIS À LUZ DO CÓDIGO CIVIL BRASILEIRO
Este artigo abordará os aspectos que poderão dar causa à invalidade do negócio jurídico, bem como suas espécies e consequências, valendo-se da codificação civil brasileira. Embora o negócio jurídico seja o livre exercício da autonomia da vontade no âmbito civil privado, não se pode concluir que essas relações jurídicas possam estar à margem da lei. Pelo contrário, a liberdade presente nas negociações tem respaldo da ordem jurídica e, sobretudo, do Código Civil brasileiro. Sendo possíveis as relações jurídicas autônomas, é certo que a característica falha do ser humano poderá refletir, causando efeitos indesejados aos negócios jurídicos. Ao tratar deste tema, será traçada uma trajetória, abordando o negócio jurídico, desde sua conceituação, os elementos essenciais de existência e de validade, passando pelos vícios de consentimento e sociais que dele corriqueiramente são decorrentes, e que poderão culminar na nulidade ou na anulabilidade do negócio jurídico

Abstract:
This article will approach about the aspects that may give rise to the invalidity of the juridical business, as well as its species and consequences, using the Brazilian Civil Code. Although the juridical business is the free exercise of autonomy of the will in the private civil sphere, it can not be concluded that these legal relationships should be outside the law. On the contrary, the present freedom in the negotiations has backing of the legal order and, mainly, of the Brazilian Civil Code. Being possible those autonomous legal relations, it is certain that the characteristic fault of the human being can reflect, causing unwanted effects to the juridical business. In dealing with this theme, a trajectory will be drawn, addressing the juridical business, from its conception, the essential elements of existence and validity, passing by the vices of consent and socials that are usually derived from it, and which may culminate in nullity or annulability of the juridical business.
