DA RESPONSABILIDADE CIVIL DA PESSOA COM DEFICIÊNCIA E DO AFASTAMENTO DA RESPONSABILIDADE CIVIL SOLIDÁRIA DO CURADOR APÓS O ADVENTO DO ESTATUTO DA PESSOA COM DEFICIÊNCIA
A presente pesquisa tem como objetivo investigar o lugar da responsabilidade civil na correspondência entre os dispositivos do Código Civil e do Estatuto da Pessoa com Deficiência. Para tanto, perpassa a interpretação dos artigos que compõem a Lei 10.406/2002 e a Lei 13.146/2015 com o intuito de delinear as dissonâncias e/ou correspondências presentes nessas legislações para, em seguida, considerar o instituto da Tomada de Decisão Apoiada como um aporte de conexão entre as leis supracitadas. Em decorrência disso é que a TDA será analisada como um processo que se inscreve em ambas as legislações e, por isso, pode auxiliar na garantia, tanto da responsabilidade civil, quanto na da capacidade legal das pessoas que a ela recorrem.

Abstract:
This research aims to investigate the place of civil liability in the correspondence between the provisions of the Civil Code and the Statute of the Person with Disability. For this purpose, it covers the interpretation of the articles that make up Law 10.406/2002 and Law 13.146/2015 with the purpose of outlining the dissonances and/or correspondences present in these legislations to then consider the institute of Supported Decision Making as an input of connection between the aforementioned laws. As a result, the TDA will be analyzed as a process that is part of both legislations and, therefore, can help to guarantee both the civil liability and the legal capacity of the people who resort to it.
