Abstract: This study has the general scope of contributing to the construction of a new Clinical Bioethics, the Bioethics of Health Care, committed to overcoming paternalism. Thus, it aims to problematize paternalism from the perspective of Shared Decision Making, demonstrating that the arguments used by Principlism to justify paternalism are inadequate. This is theoretical research based on studies on the Bioethics of Health Care, Shared Decision Making, and paternalism, formulated within the scope of Principlism. It is concluded that Clinical Bioethics needs to integrate the moral progress achieved in the field of health, reflected in the inclusion of patients' needs, preferences, and desires in the clinical encounter. It is emphasized that the maintenance of paternalism puts the quality of care at risk and weakens the bond between health professionals and patients, who increasingly appropriate their role as agents and decision-makers.
