Abstract: Critical criminology focuses on analyzing power relations, domination and social inequalities in society. The capitalist structure plays a fundamental role in this process, as it is a pillar of class division, inequalities and criminalization of marginalized groups, equally responsible for making poverty naturalized and stigmatized, leading to discrimination and hostility. Critical criminology, then, seeks to transform these structures, questioning the State's exclusionary criminal policy and aiming for a society based on justice and inclusion. This study will address how the concept of aporophobia relates to critical criminology, considering the role of capitalism and the exclusionary criminal policy of the Brazilian State in the reproduction and reinforcement of segregation and marginalization of the poor. The research covers critical criminology, Marxist thinking about capitalist logic and, finally, aporophobia as a concrete example of the exclusionary criminal process. Using bibliographical research, we seek to better understand the connection between these elements and their implications for society.
