CRIANÇA E O DIREITO A EDUCAÇÃO: UM DIREITO AMPARADO PELO ESTATUTO DA CRIANÇA E ADOLESCENTE - ECA
Este artigo objetiva-se em evidenciar as melhorias obtidas com a criação e a implementação do Estatuto da Criança e do Adolescente (ECA), que surgiu em um contexto de lutas sociais que pressionavam o governo por uma legislação que assegurasse direitos essenciais ao público infanto-juvenil, principalmente o direito à educação. Este estudo utilizou-se da metodologia de pesquisabibliográfica qualitativa, a qual visa abordar sobre uma temática pertinente na sociedade. Assim, estapesquisa foi construída com embasamento em legislações, artigos científicos, pesquisas bibliográficas online e especialmente a análise da lei nº 8.069/1990 de 13 de julho de 1990. Nesta perspectiva, os resultados aqui encontrados leva a uma reflexão sobre a diferença da existência teórica de uma legislação e a sua respectiva prática no meio social, como é o caso do ECA que é uma Lei nascida depois da Constituição de 1988 com o intuito de destacar as garantias dadas pela Carta Magna e ainda ofertar outros direitos fundamentais para melhor qualidade de vida das crianças, por meio do enfrentamento ao trabalho infantil, ao abandono, aos maus tratos e a falta de educação escolar para todos. Assim, nota-se que as leis surgem para atender as demandas sociais em específico, como é o caso do ECA que atende todas as demandas infanto-juvenil.

Abstract:
This article aims to highlight the improvements obtained with the creation and implementation of the Child and Adolescent Statute (ECA), which emerged in a context of social struggles that pressured the government for legislation that would ensure essential rights for children and adolescents. youth, especially the right to education. This study used the methodology of qualitative bibliographic research, which aims to address a relevant theme in society. Thus, this research was built based on legislation, scientific articles, online bibliographic research and especially the analysis of law nº 8.069/1990 of July 13, 1990. In this perspective, the results found here lead to a reflection on the difference of existence theory of a legislation and its respective practice in the social environment, as is the case of the ECA which is a law born after the 1988 Constitution with the aim of highlighting the guarantees given by the Magna Cartaand also offering other fundamental rights for a better quality of life. children's lives, by fighting child labor, abandonment, mistreatment and lack of school education for all. Thus, it is noted that laws arise to meet specific social demands, as is the case of the ECA that meets all children's demands.
