COVID-19 E DIREITOS FUNDAMENTAIS: UM OLHAR PARA GRUPOS VULNERÁVEIS
A pandemia causada pelo COVID-19 é discriminatória, no enfrentamento ao vírus, grupos vulneráveis sofrem mais que outros. Percebe-se que a crise pandêmica se instalou sobre outra de baixa efetividade de direitos fundamentais. Neste sentido, coube a este artigo analisar o caráter discriminatório da pandemia, apontar grupos vulneráveis e analisar o dever agir do Estado Democrático de Direito no enfrentamento do vírus e na efetivação de direitos fundamentais. Outrossim, abordou a recomendação 62 do CNJ como possibilidade de preservação da dignidade da pessoa humana do grupo de risco que vive em cárcere.

Abstract:
The pandemic caused by COVID-19 is discriminatory, in facing the virus, vulnerable groups suffer more than others. It can be seen that the pandemic crisis was installed over another with a low effectiveness of fundamental rights. In this sense, it was up to this article to analyze the discriminatory character of the pandemic, to point out vulnerable groups and to analyze the duty of the Democratic Rule of Law to face the virus and to enforce fundamental rights. Furthermore, he addressed the recommendation 62 of the CNJ as a possibility of preserving the dignity of the human person from the risk group that lives in prison.
