CONTROLE DA ADMINISTRAÇÃO PÚBLICA PELO TRIBUNAL DE CONTAS E LIMITES MATERIAIS DE SUAS DECISÕES
o objeto deste artigo corresponde ao Tribunal de Contas e aos limites materiais das suas decisões. Para desenvolvê-lo, traça-se brevemente a formação no Brasil desse órgão e apresenta-se o desenvolvimento das concepções atualmente vigentes de controle na Administração pública. Parte-se então para a análise da estrutura normativa definida pela Constituição Federal de 1988 sobre a matéria e, a partir dessas premissas, busca-se desenvolver critérios interpretativos a serem aplicados para a delimitação do alcance do poder de controle do Tribunal de Contas (e o seu grau de vinculatividade), tendo em conta parâmetro de correção adotado (em especial, legalidade, legitimidade e economicidade).

Abstract:
the object of this article corresponds to the Audit Court and the material limits of its decisions. In order to develop it, the formation of this entity in Brazil is briefly outlined and the development of the current conceptions of control in public administration is presented. We then proceed to analyze the normative structure defined by the Federal Constitution of 1988 on the matter and, based on these premises, we seek to develop interpretative criteria to be applied to delimit the scope of the Audit Court’s control power (and its degree of binding), taking into account the adopted parameter of correctness (in particular, lawfulness, legitimacy and economic efficiency).
