Abstract: In this text the service provision contract signed with individuals was analyzed from the beginning of the planning process, including the elements of price, justification of need, and obligations. A poor definition of these can distort the contractual relationship, leading to condemnatory rulings against the Colombian State and inefficient contract execution. The article began by studying regulations, high court rulings, legal doctrine, scientific articles, and the results of a survey conducted by ministries and the National Planning Department regarding contracts signed during the 2021 to 2024 periods, which are key entities at the national and territorial levels. Information was also studied from direct sources such as Colombia Compra Eficiente, the State Legal Defense Agency, and the Administrative Department of the Civil Service. The main finding is that service provision contracts signed with individuals are essential for the fulfillment of the State's objectives, contrary to the premise that they should be eliminated. An annual increase was observed in the hiring of personnel under this category, whose contractual work contributes significantly to public management. However, deficiencies persist in planning, particularly in the justification of fees, the description of needs, and the definition of obligations. Opportunities for improvement were identified, as these elements enable effective contract execution, respecting the contractor's autonomy and focusing on achieving results that strengthen the entities' capacity to meet their institutional objectives.
