Abstract: Prior consultation is a fundamental right of indigenous peoples in Peru, recognized both nationally and internationally, which seeks to guarantee their participation in decisions that affect their lands, territories, and natural resources. This scientific article examines the evolution and application of prior consultation in Peru since the enactment of the Law on Prior Consultation in 2011 until 2024, with a focus on the processes carried out in different departments of the country and the issues that have been subject to consultation. Through an exhaustive analysis of data from the Ministry of Culture, a significant concentration of consultation processes is identified in departments such as Ayacucho, Cusco, Loreto and Ucayali, regions characterized by their high extractive activity and the presence of indigenous communities. The predominant themes in the consultations include mining, hydrocarbons, and the protection of natural areas and cultural heritage, reflecting the main interests and concerns of local communities. The results indicate that, although the implementation of prior consultation has advanced in several regions of the country, significant challenges persist in terms of coverage, effectiveness, and respect for the rights of affected communities. The tensions between economic development and the protection of indigenous rights are also discussed, highlighting the need to strengthen consultation mechanisms in order to ensure the protection of indigenous rights.
