CONSIDERAÇÕES INICIAIS ACERCA DA REDISTRIBUIÇÃO DO ÔNUS DA PROVA NOS GRANDES DESASTRES DA MINERAÇÃO
O estudo se utiliza do conceito de sociedade de risco e da teoria da carga dinâmica da prova na tentativa de proceder a uma redistribuição mais justa do ônus da prova nas ações de indenização por danos materiais decorrentes das grandes tragédias provocadas pelo setor de mineração. Aponta-se que a aplicação da responsabilidade objetiva nas atividades de risco não possui, sozinha, a condição de levar justiça ao caso concreto. O entendimento proposto neste trabalho impõe à mineradora, que possui mais conhecimento técnico, bem como recursos materiais e econômicos, o ônus de provar a extensão do dano material sofrido pelo atingido.

Abstract:
The study uses the concept of risk society and the theory of dynamic load of evidence in an attempt to redistribute the burden of proof more in the indemnity actions for material damages resulting from the great tragedies caused by the mining sector. It is pointed out that the application of strict liability in risk activities does not, on its own, have the condition to bring justice to the specific case. The understanding proposed in this work imposes on the mining company, which has more technical knowledge, as well as material and economic resources, the burden of proving the extent of the material damage suffered by the victim.
