Esta pesquisa tem como temática o

estudo da violência de gênero, no âmbito das

relações privadas, em desfavor das mulheres

negras. Dessa forma, objetiva-se, de modo

geral, compreender os motivos da existência da

violência doméstica e familiar contra as vítimas

ora estudadas, e, em específico, analisar os

dados que dizem respeito a tal violência –

especialmente contra as mulheres negras,

compreender os fenômenos sociais que fazem

perdurar a violência contra a mulher e estudar

quais normas jurídicas as amparam em âmbito

doméstico e familiar. Para tanto, utilizou-se de

uma abordagem qualitativa, a partir de métodos

exploratórios e descritivos, fazendo uso,

essencialmente, de pesquisas bibliográficas

em livros, sítios eletrônicos, artigos e revistas

científicas. Com isso, concluiu-se que a

negritude feminina é o principal alvo da violência

doméstica e familiar no Brasil, e tal fato é

oriundo da desigualdade de gênero, visto que a

sociedade patriarcal torna a mulher submissa e

inferior ao homem; e da desigualdade de raça,

pois as mulheres negras são tratadas com

discriminação devido à cor da sua pele. Por tal

verdade, é que a mulher negra é a que mais se

beneficia com a Lei no

11.340/06 - Lei Maria da

Penha.

Abstract:
This research has as its theme

the study on the Gender Violence, in a private

relationship environment and in disfavor to the

black women. This way, the main objective is

to understand why the dwelling and familiar

violence against the studied victims still

exists, specifically against the black women;to

comprehend the social phenomena that makes

the violence against the women continue and

study which legal regulations support them

in both dwelling and familiar environment.

Therefore, it was used a qualitative approach,

based on exploratory and descriptive methods,

using, essentially, bibliographical researches in

books, websites, scientific articles and scientific

magazines. Between this and that, it was

concluded that the female blackness is the main

target of the dwelling and familiar violence in

Brazil, this fact arises from the gender inequality,

keeping in mind that the patriarchal society makes the women submissive and lower

to the men; and from the inequality of race, because the black womenare treated with

discrimination due to the color of their skin. Being this truth, the black women are the

most benefit to the Law No 11.340/06 – Lei Maria da Penha.
