CONCEITO DE FILIAÇÃO: ORIGENS E EVOLUÇÃO NO DIREITO BRASILIEIRO
O presente trabalho visa analisar o conceito de filiação, que, conjuntamente ao conceito de família, passou por alterações relevantes. O viés da proteção patrimonial do direito de família, paulatinamente foi substituído por critérios de afeto mútuo. Neste sentido, a Constituição Federal de 1988 foi determinante para, antes mesmo da edição do Código Civil de 2002, proibir a distinção entre filhos decorrente da origem. Ainda sobre o tema filiação, novas técnicas de reprodução assistida, constituem fonte de vínculos que necessitam de regulação pelo direito. Em todo o contexto observado na atualidade, a família mostra-se como instrumento, o ambiente para que a pessoa desenvolva sua condição existencial, em conformidade com a prevalência da dignidade da pessoa humana.

Abstract:
The present work aims to analyze the concept of affiliation, which, together with the concept of family, has undergone relevant changes. The heritage protection bias of family law was gradually replaced by criteria of mutual affection. In this sense, the Federal Constitution of 1988 was decisive for, even before the edition of the Civil Code of 2002, prohibiting the distinction between children due to origin. Still on the subject of affiliation, new techniques of assisted reproduction constitute a source of bonds that need regulation by law. In all the context currently observed, the family appears as an instrument, the environment for the person to develop his existential condition, in accordance with the prevalence of the dignity of the human person.
