COMO FAZEMOS UM PROCESSO: UMA ANÁLISE CRÍTICA DO PODER DECISÓRIO DO JUIZ E OS REFLEXOS NA SOCIEDADE DO ESPETÁCULO.
Esse artigo é fruto de uma série de pesquisas na área de Teoria Geral do
Processo, onde analisa-se a atuação do magistrado durante atividade jurisdicional e
os reflexos dessa atuação decisória na sociedade, seja essa decisão na esfera penal
ou cível. Para tal missão realiza-se uma análise crítica dos principais teóricos da
atualidade sobre a temática: Francesco Carnelutti, Ronald Dworkin, Herbert Hart e
Lenio Streck e outros. Opta-se por utilizar método qualiquantitativo com base na
técnica da fenomenologia pela vasta bibliografia disponível. No que tange a estrutura
do artigo, esclarece-se sua divisão em três importantes aspectos, quais sejam:
formação dos Tribunais brasileiros; liberdade dos magistrados para a atividade
decisória, seus critérios e os reflexos dessa decisão na sociedade. Portanto, trata-se
de uma análise em cadeia dos principais elementos da função precípua do Poder
Judiciário: julgar. Acredita-se que ao final desse trabalho se obteve uma relevante
base para tecer considerações acerca da temática. Não obstante, cumpre registrar
o caráter ímpar do estudo, uma vez que, analisar o Processo Judicial de maneira
crítica é uma atividade de interesse não só da comunidade acadêmica, como
também da sociedade.

Abstract:
This article is the result of a series of researches in the area of General
Theory of the Process, which analyzes the performance of the magistrate during
judicial activity and the reflexes of this decision making in society, be it decision in
the criminal or civil sphere. For this mission a critical analysis of the main theorists of
the present time on the subject is done: Francesco Carnelutti, Ronald Dworkin,
Herbert Hart and Lenio Streck and others. We chose to use qualitative quantitative
method based on the technique of phenomenology by the vast bibliography available.
Regarding the structure of the article, it is clarified its division into three important
aspects, namely: formation of the Brazilian Courts; freedom of magistrates for
decision-making activity, their criteria and the consequences of that decision in
society. Therefore, it is a chain analysis of the main elements of the primary function
of the Judiciary: to judge. It is believed that at the end of this work a relevant basis
was obtained to make considerations about the theme. Nevertheless, it is important
to note the unique nature of the study, since analyzing the Judicial Process critically
is an activity of interest not only to the academic community, but also to society.
