CARACTERÍSTICAS DO REGIME DE PERMISSÃO DE LAVRA GARIMPEIRA NO ÂMBITO DA LEGISLAÇÃO MINERÁRIA E OS PRINCIPAIS DESAFIOS AMBIENTAIS
O regime de permissão de lavra garimpeira, em sua concepção
técnica e jurídica, representa para uma parcela significativa de mineradores
e/ou garimpeiros, uma ferramenta de apoio a mineração artesanal, por possuir
menor nível de burocracias se comparado aos demais mecanismos
existentes. No contexto de sua concepção, existe a necessidade de respeito
as normas minerárias e ambientais, em especial na elaboração dos projetos
que serão submetidos a Agência Nacional de Mineração e aos órgãos
ambientais competentes, de modo que estes consigam mapear os principais
pontos do futuro empreendimento, para que práticas de mitigação,
recuperação e preservação, além da garantia de segurança ao trabalhador
inserido nesta, sejam executados coerentemente, além da fiscalização incisiva
de modo a coibir práticas predatórias e/ou irregulares. Para tanto, este
trabalho tem como principal objetivo demonstrar a forma do regime de
permissão de lavra garimpeira na legislação minerária, sua operação e os
impactos mais comuns. Com esse propósito, utilizou-se banco de dados sobre
a legislação minerária, por meio de consultas a sítios físicos e digitais, bem
como de conhecimentos já difundidos nos meios técnicos, científicos e
acadêmicos sobre a operação de mina e de mapeamento dos impactos
ambientais conhecidos de primeira ordem.

Abstract:
The mining permission regime, in its technical and legal
conception, represents for a significant portion of miners and/or prospectors, a
support tool for artisanal mining, as it has a lower level of bureaucracy
compared to other existing mechanisms. In the context of its design, there is a
need to respect mining and environmental standards, especially in thepreparation of projects that will be submitted to the National Mining Agency
and the competent environmental bodies, so that they can map the main points
of the future enterprise, so that mitigation, recovery and preservation practices,
in addition to guaranteeing the safety of the worker included in this, are carried
out coherently, in addition to incisive supervision in order to curb predatory
and/or irregular practices. Therefore, this work has as main objective to
demonstrate the form of the gold mining permission regime in the mining
legislation, its operation and the most common impacts. For this purpose, a
database on mining legislation was used, through consultations on physical
and digital sites, as well as knowledge already disseminated in technical,
scientific and academic circles about mine operations and mapping of known
environmental impacts of first order.
