ATIVISMO JUDICIAL E JUDICIALIZAÇÃO DA POLÍTICA NO SUPREMO TRIBUNAL FEDERAL
O artigo trata sobre o ativismo judicial e judicialização da política no STF, passando pela história da Corte e identificando a promulgação da constituição como o grande marco da sua história. Apresentada a pesquisa de Thamy Pogrebinschi sobre o quantitativo de ativismo judicial no STF e comentários do autor Lenio Streck sobre o estudo. A teoria da separação dos poderes é brevemente explicada através de uma metáfora. Ao cabo, é reconhecida a função contramajoritária e iluminista do STF, alertando, porém, que a instituição pode já dar sinais de arbitrariedade no uso do ativismo judicial e em decisões de política judicializada.

Abstract:
This article is about judicial activism and judicialization of politics in the Brazilian Supreme Court (STF). It analyzes its history and identifies the 1988 Constitution as its turning point. Thamy Pogrebinschi's research on judicial activism statistics in the Court is presented along with author Lenio Streck's comments. The separation of powers theory is briefly explained through a metaphor lence. In the end, the Court’s counter-majoritarian and Enlightenment function is recognized, however, it is noted the institution may already have shown signs of abuses in the use of judicial activism and in decisions of judicialized policy
