ASSOCIAÇÃO E SUA LEGITIMIDADE - DIREITO COMPARADO
O presente artigo trata com clareza de detalhes da lei, quanto a legitimidade de associar-se. A análise detia da lei nos permite elucidar dúvidas quanto aos questionamentos advindos principalmente das seguradoras e seu agente regulador sobre a legitimidade das associações, sob o argumento de "concorrência desleal". Fato esse que se dá única e exclusivamente por uma busca equivocada de monopólio no mercado, ressaltando ainda que essa demanda não integra a perspectiva regulatória que compreende os objetivos institucionais dessa autarquia federal na fiscalização do mercado privado de seguros, atividade privativa da União.

Abstract:
This article deals clearly with the details of the law, regarding the legitimacy of membership. The in-depth analysis of the law allows us to elucidate doubts about the questions arising mainly from insurance companies and their regulator about the legitimacy of associations, under the argument of "unfair competition". This fact occurs solely and exclusively through a misguided search for monopoly in the market, emphasizing that this demand does not integrate the regulatory perspective that comprises the institutional objectives of this federal autarchy in the inspection of the private insurance market, a private activity of the Union.
