Abstract: The Labor Reform was a profound setback in workers’ rights, especially regarding the issue of “Non-Patrimonial Damages”, by setting compensation by level of injury and the worker’s salary. In this scenario, the issue of “Moral Harassment” and its respective compensations were directly impacted, especially regarding equality and human dignity. In order to demonstrate the regulatory setback in the labor sphere regarding moral harassment and analyze the impact on lawsuits on the subject, we retrieved and studied statistical data from the Superior Labor Court (TST) and identified a progressive decline in the number of lawsuits related to the subject. Given this moral bias, which goes against the principle of reparation and the growing political and organizational concerns about the problem, this study presents some constitutional contradictions and proposes ethical reflections, to the extent that the approved reform portrays a paradox, since the Entity that establishes Rights cannot legislate against the constitutional premises previously assumed. From these perspectives, we should clearly recognize the limits of legal norms when dissociated from the reality of injustices. To this end, Bioethics is advocated as a coherent approach capable of resolving moral conflicts, especially Organizational Ethics, since it reveals possibilities for analysis, understanding and action in the face of harassing (unethical) practices at work and for thinking of collective solutions to these moral issues.
