ASPECTOS TÉCNICOS E JURÍDICOS DO DESNATE DA GORDURA LÁCTEA EXTRAÍDA DA ETAPA DE FILAGEM DE QUEIJOS
O desnate da gordura láctea extraída da etapa de filagem de queijos era considerado proibido pelo Ministério da Agricultura, Pecuária e Abastecimento (MAPA). Todavia, o art. 370 do Decreto nº 9.013/2017 permite tal desnate desde a sua entrada em vigor e o art. 385-A do mesmo Decreto – editado em agosto de 2020 – somente confirmou de modo cabal tal possibilidade. Apesar disso, a prática vem sendo inviabilizada pelo MAPA até o momento, sob o argumento da pendência de norma administrativa específica. O presente artigo tem o objetivo de demonstrar, a partir dos aspectos jurídicos e técnicos relacionados, que o desnate dessa gordura láctea é lícito desde 2017 – observando as normas sanitárias vigentes – e que deve ser estimulado, tendo em vista as repercussões ambientais, econômicas e alimentares positivas à sociedade, indústria, fisco e consumidores. Conclui-se que tal desnate deve ser imediatamente permitido, independentemente de regulamentos suplementares, mediante a observância pelas indústrias dos demais procedimentos do Decreto nº 9.013/2017.

Abstract:
The skimming of the dairy fat extracted from the cheese filing stage was considered prohibited by the Ministry of Agriculture, Livestock and Supply (MAPA). However, art. 370 of Decree N. 9.013/2017 allows such skimming since its implementation and art. 385-A of the same Decree - issued in August 2020 - only fully confirmed this possibility. Despite this, the practice has been unfeasible by MAPA so far, under the argument that a specific administrative rule is required. This article aims to demonstrate, from the related legal and technical aspects, that the skimming of this dairy fat has been lawful since 2017 - observing the current sanitary standards - and that it should be stimulated, in view of the environmental, economic and food repercussions to society, industry, tax authorities and consumers. We concluded that such skimming should be immediately allowed, regardless of supplementary regulations, through the observance by the industries of the other procedures of Decree nº 9.013/2017.
