ASPECTOS JURÍDICOS DO BULLYING ESCOLAR E A RESPONSABILIDADE DAS INSTITUIÇÕES
O Bullying é um fenômeno social
presente há muito tempo nas instituições de
ensino. A sua ocorrência pode causar sequelas
permanentes em suas vítimas, gerando,
portanto, um enorme prejuízo a elas. Dessa
maneira, essa prática passou a repercutir
na área jurídica. Caso essa atividade seja
evidenciada no ambiente escolar, é, segundo
o Código Civil Brasileiro, de responsabilidade
objetiva de tal instituição reparar o dano,
amparando as vítimas, punindo os agressores
e até mesmo indenizando nos casos os quais
a instituição seja omissa. De natureza básica,
o presente trabalho ateve-se a materiais já
publicados em diferentes plataformas para
debater de forma mais ampla essa questão e
a sua implicação na sociedade, principalmente
na responsabilização desses atos, o que
resultou na constatação de que, apesar dos
esforços nos mais diferentes setores, como
no legislativo, ainda evidencia-se a ocorrência
dessa situação, a qual deve ser erradicada.

Abstract:
Bullying is a long-standing social
phenomenon in educational institutions. Its
occurrence can cause permanent sequelae in
its victims, therefore generating a huge loss to
them. In this way, this practice began to have
repercussions in the legal area. If this activity
is evidenced in the school environment, it
is, according to the Brazilian Civil Code, the
objective responsibility of such institution to
repair the damage, supporting the victims,
punishing the aggressors and even indemnify in
cases in which the institution is silent. Of a basic
nature, the present work is based on materials
already published in different platforms to discuss
this issue in a broader way and its implication
in society, especially in the accountability of
these acts, which resulted in the realization
that, despite efforts in different sectors, as in
the legislature, it is still evident the occurrence
of this situation, which must be eradicated.
