ASPECTOS DEMOCRÁTICOS NA CONCORRÊNCIA ENTRE AS NORMATIVIDADES
O contexto no qual o Estado moderno está inserido desencadeou uma
abertura de fronteiras e readequação das funções estatais, obrigando o ente estatal a
dividir seu protagonismo internacional com atores não estatais. O fenômeno da
globalização provocou um grande impacto no papel do Estado, uma vez que este,
mediante a nova perspectiva global, mostrou-se incapaz de manter o seu monopólio na
elaboração de normas que regem as relações provenientes de uma sociedade cada vez
mais complexa. Os pressupostos da democracia, nesse novo contexto jurídico e político,
são postos à prova sendo necessário analisar em que medida a internormatividade,
através de normas técnicas e de gestão, interfere nos ordenamentos jurídicos internos
provocando a sua transformação. Conclui-se que a atuação da sociedade civil seria um
mecanismo que, ao debater e contestar as normatividades emergentes do pluralismo
transnacional, poderia legitimar o uso dos standards e indicadores na gestão
governamental. Por fim, defende-se a necessidade da ampliação da reflexão sobre as
novas normatividades frente aos preceitos democráticos modernos.

Abstract:
The context in which the modern State is inserted has triggered an
opening of borders and readjustment of state functions, forcing the state entity to share
its international role with non-state actors. The phenomenon of globalization has had a
great impact on the role of the State, since it, through the new global perspective, has
shown itself incapable of maintaining its monopoly in the elaboration of norms that
govern the relations arising from an increasingly complex society. The assumptions of
democracy, in this new legal and political context, are put to the test and it is necessary
to analyze the extent to which internormativity, through technical and management
standards, interferes with internal legal systems, causing their transformation. It is
concluded that the action of civil society would be a mechanism that, by debating and
contesting the norms emerging from transnational pluralism, could legitimize the use ofstandards and indicators in government management. Finally, it defends the need to
expand the reflection on the new norms in the face of modern democratic precepts.
