ASPECTOS DA REGULAÇÃO NA PRESTAÇÃO DE SERVIÇOS PÚBLICOS EM REGIÕES METROPOLITANAS
O propósito deste artigo é abordar
aspectos relacionados a prestação de serviços
públicos e regulação destes serviços nas regiões
metropolitanas no Brasil. Para tanto, analisase
as características institucionais da forma
federativa e conflitos em relação a autonomia
municipal nestes conglomerados urbanos que
extrapolam os limites de municípios. O ponto
central é a regulação da prestação de serviços
públicos nestas regiões, abordando aspectos
institucionais das Agências Reguladoras e suas
competências. Se for um serviço público de
interesse local, a competência para conceder
estes serviços a terceiros, é do município, no
entanto, nas regiões metropolitanas, o interesse
passa a ser regional. Portanto, este conflito de
competência sobre a concessão de um serviço
público, como o de saneamento básico, e a
escolha da entidade reguladora também são
tratados.

Abstract:
The purpose of this article is to
address aspects related to the provision of
public services and regulation of these services
in the metropolitan regions in Brazil. For that,
the institutional characteristics of the federative
form and conflicts with the municipal autonomy
in these urban conglomerates that extrapolate
the limits of municipalities are analyzed. The
central point is the regulation of the provision
of public services in these regions, addressing
institutional aspects of Regulatory Agencies
and their competencies. If it is a public service
of local interest, the competence to grant these
services to third parties, is of the municipality,
however, in the metropolitan regions, the interest
happens to be regional. Therefore, this conflict
of jurisdiction over the provision of a public
service, such as basic sanitation, and the choice
of the regulatory body are also addressed.
