AS RELAÇÕES DE PODER E DECISÃO NA AMÉRICA LATINA: REVISITANDO O AUTORITARISMO E AS IMPLICAÇÔES NA DESCONSTRUÇÂO DA DEMOCRACIA
A incapacidade de compreender e
realizar a democracia assumiu diversas faces
na América Latina, em diferentes momentos
de sua história, A tradição autoritária marcada
pela desvalorização da participação política e
fragilidade das instituições sempre expôs, com
inesquecível presença, as relações de poder
e decisão, típicas do cenário latino americano.
As estratégias de apropriação do poder
político, no sentido de elevação da autoridade
e dominação, resultaram em uma importante
temática histórica apresentada pela literatura. A
personificação do autoritarismo em governantes,
afetada por desmandos, arbitrariedades e
imposições injustificadas é testemunhada na
estrutura narrativa de ‘Sabres e Utopias’, obra
do peruano Mario Vargas Lhosa. O estilo forte
e inovador aborda as ameaças à credibilidade
das democracias, como um ato corajoso de
denúncia e de chamada à consciência. Em
momentos de crise e diluição de valores, tornase reação comum da sociedade a busca por
soluções rápidas para amenizar a tragédia do
viver. O surgimento de um salvador dotado de
virtudes carismáticas, capaz de trazer uma nova
época de verdade e justiça, ao enaltecer valores
e sentimentos tradicionais, não é fato novo
nas referências histórico-culturais da América
Latina. O Brasil, em especial, foi pródigo em
movimentos intitulados como messiânicosmilenaristas pelos cientistas sociais, a citar,
como exemplo, o caso do Contestado e
Canudos. Os líderes messiânicos brasileiros
envolveram-se em lutas políticas, mas sempre
como aliados de mandatários locais e regionais.
Tais movimentos traduzem os momentos de
anomia de uma sociedade por meio do único
canal possível de expressão de insatisfação. A
metodologia utilizada será bibliográfica com o
objetivo de tornar o trabalho um espaço teórico
para se pensar o Direito, em suas conexões com
outras práticas artísticas e reflexões críticas, a
partir de diferentes perspectivas, não como um
campo fechado, mas como um movimento em
direção a tudo o que o transforma. A partir de
produções literárias, o artigo se propõe a ampliar
o diálogo entre Direito e Literatura, como forma
de interpretar os recentes acontecimentos
político-sociais da América Latina, sobretudo do
Brasil, e as suas implicações na desconstrução
da estrutura democrática.

Abstract:
In Latin America, the inability to understand and effectuate democracy
has taken on many shapes and forms at different times throughout its history. The
authoritarian tradition marked by the deliberate erosion of political participation and
democracy’s inherent weaknesses has exposed, with unforgettable presence, the
relationship between power and decision, so typical of the Latin American political
structure. Strategies of appropriation of political power, in reference to authority
and domination, has resulted in an important topic presented by the literature. The
personification of authoritarianism in political figures, affected by unjustified misconduct,
arbitrariness, and imposition is witnessed in the narrative of “Sabers and Utopias”, by
Peruvian Mario Vargas Lhosa. The strong and innovative style addresses threats to the
credibility of democracies, as a courageous act of denunciation and a call to conscience.
In moments of crisis and weakness of values, it becomes a common reaction of society
to search for quick solutions in order to mitigate the hardships of living. The attraction
of a savior-demagogue endowed with charismatic virtues, capable of bringing about
a new movement of truth and justice by praising traditional values and feelings, is not
a new concept in historical-cultural references of Latin America. Brazil, in particular,
was rife with movements called messianic-millennialists, e.g., the case of Contestado
and Canudos. Brazilian messianic leaders engaged in such struggles but always with
the complicit support of local and regional representatives. Such movements may
explain the moments of societal anomie through the only possible channel to express
dissatisfaction. The methodology used here will be bibliographic, with the objective of
making the work a theoretical space to think about the law in its connections with other
artistic practices and critical reflections from different perspectives, i.e., not as a closed
field, but as a metamorphic movement effectuating a transformative change. Based
on literary publications, the article proposes to expand the dialogue between law and
literature as a way of interpreting recent political and social events in Latin America and
Brazil, and the inherent implications of the deconstruction of the democratic structure.
