AS ORIENTAÇÕES TÉCNICAS QUE NORMATIZAM SERVIÇOS DE ACOLHIMENTO PARA CRIANÇAS E ADOLESCENTES EM MEDIDA PROTETIVA NO BRASIL E O DIREITO À EDUCAÇÃO DOS/AS ACOLHIDOS/AS
Acolhimento institucional e familiar
é uma das medidas de proteção prevista no
Estatuto da Criança e do Adolescente (ECALei
8.069/90). Essas medidas socioprotetivas
são aplicadas quando estes têm os seus
direitos violados, sendo a medida protetiva de
acolhimento aplicada quando a família natural
ou extensa não os consegue proteger de forma
integral. Dessa maneira, os mesmos passam a
viver sob a tutela do estado que tem obrigação
de garantir o desenvolvimento integral deles. Há
legislações e normatizações que asseguram os
direitos das crianças e adolescentes acolhidos,
dentre elas, as “Orientações Técnicas: Serviços
de Acolhimento para Crianças e Adolescentes”.
Diante disso, esse artigo tem o objetivo de
analisar se e como o direito à educação aparece
neste documento que regulamenta, a nível
nacional, a organização e oferta de serviços de
acolhimento para crianças e adolescentes. Essa
pesquisa, de cunho qualitativo e bibliográfico,
revelou que, nas referidas Orientações, é
garantido o direito à educação através de
permanente comunicação dos serviços de
acolhimento com a rede de educação, bem
como a preocupação com a educação formal e
informal que acontece dentro das instituições.
Também revelou a necessidade de inclusão de
um pedagogo na equipe interprofissional desses
serviços com vistas a otimizar os processos
educacionais necessários para que crianças e
adolescentes possam adquirir conhecimentos
e habilidades para exercer sua cidadania,
ter inserção social e um projeto de vida que
priorize a emancipação e a autonomia visando
minimizar as exclusões, injustiças sociais e
violações de direitos sofridas.

Abstract:
Institutional and family housing
is one of the protection measures foreseen in
the Child and Adolescent Statute (ECA - Law
8.069 / 90). These socio-protective measures
are applied when they have their rights violated,
and the protective protective measure applied
when the natural or extended family can not
fully protect them. In this way, they start to live
under state protection which has an obligation
to ensure the full development of them. There
are laws and regulations that ensure the rights
of children and adolescents welcomed, among
them, the “Technical Guidelines: Home Services
for Children and Adolescents.” Therefore, this
article aims to analyze if and how the right to
education appears in this document that regulates, at a national level, the organization
and provision of childcare services for children and adolescents. This qualitative and
bibliographical research revealed that, in the aforementioned Guidelines, the right to
education is guaranteed through the permanent communication of the host services
with the education network, as well as the concern with formal and informal education
that takes place within the institutions. It also revealed the need to include a pedagogue
in the interprofessional team of these services with a view to optimizing the educational
processes necessary for children and adolescents to acquire knowledge and skills
to exercise their citizenship, have social insertion and a life project that prioritizes
emancipation and autonomy in order to minimize the exclusions, social injustices and
violations of rights suffered.
