AS MÚLTIPLAS DIMENSÕES DE ATUAÇÃO DA JUSTIÇA ELEITORAL E SUA IMPORTÂNCIA NA GARANTIA DA REPRESENTATIVIDADE DEMOCRÁTICA
É consenso na doutrina especializada que a Constituição da República adotou o modelo representativo de democracia. O texto do parágrafo único do art. 1º da Carta Política denota essa escolha, ao consignar que “todo o poder emana do povo, que o exerce por meio de representantes eleitos”, sendo exceção o exercício direto do poder popular. Também por disposição constitucional, a seleção desses representantes ocorre por meio de processo eleitoral, o qual, no Brasil, é organizado pela Justiça Eleitoral, que é um sistema de órgãos e autoridades que integra o Poder Judiciário. O presente trabalho possui como objetivos: investigar as razões da designação da Justiça Eleitoral como encarregada da condução do processo eleitoral; examinar a estrutura institucional da Justiça Eleitoral; e compreender as diferentes funções exercidas pela Justiça Eleitoral. O trabalho conclui pela existência de cinco dimensões de atuação dessa justiça especializada: administrativa; judicial; normatizadora; consultiva; e científica.

Abstract:
It is consensus among researchers that the Brazilian Constitution has adopted a representative model of democracy. The constitutional text makes this choice clear when it states that “all power emanates from the people, which exerts it through elected mandataries”, rule that makes the direct exercise of power by the people an exception. Also due to constitutional determination, the selection of such mandataries is carried out through elections, which, in Brazil, are organised by the Electoral Justice – a system of institutions and authorities that integrate the Judiciary branch of government. This paper intends to: investigate the reasons why the Electoral Justice has been designated by the Constitution to be in charge of the elections; examine the structure of the the Electoral Justice; and comprehend the different roles played by the Electoral Justice in the political system. The conclusion points out that the Electoral Justice acts in five different dimensions: administrative; judicial; normative; consultive; and scientific.
