A Constituição Federal define, em seu artigo 5º, que todos são iguais perante a lei; porém, o presente projeto de pesquisa tem como objetivo entender os fatos legais e sociais que fazem este marco da Carta Magna do Brasil ser descumprido, até a necessidade da criação da Lei nº 11.340 (BRASIL, 2006), conhecida como Maria da Penha, cuja finalidade consiste em proteger as mulheres do risco e da segregação da sociedade patriarcal contemporânea
