Abstract: The “democratic” management of public schools in Brazil was included in the Federal Constitution (CF) in 1988 and reaffirmed by the Law of Directives and Bases in 1996. Therefore, it is in this context that we will discuss concepts and analyze what management is, how it becomes democratic and how this democratic management takes place in Mariana's municipal schools. This is a bibliographic research developed based on official documents related to Brazilian educational public policies. Our objective is to discuss the possibility or not of guaranteeing democratic management as provided for in the current legislation, as well as presenting the proposals for democratic management expressed in Brazilian legal documents, based on reference authors in the area, such as Follet (1997, 2011) , Faro (2003), Libâneo (2008) among others. One of the hypotheses addressed in the project is that the difficulties or impossibilities of guaranteeing the democratic management provided for in the legislation are a discontinuity or non-uniformity on the idea of democratic management in the current legislation until its implementation in the school. After analyzing the official documents of the three spheres of power, the FC, the Law of Directives and Bases of National Education and the Education Plans, we found the existence of variables in public schools that must be combined so that the implementation of democratic management occurs.
