AS INOVAÇÕES TRAZIDAS ATRAVÉS DO ACORDO TRIPS EM RELAÇÃO ÀS PATENTES DE MEDICAMENTOS E O ÓBICE AO ACESSO A FÁRMACOS
O presente artigo tem como
finalidade apresentar o conteúdo do Acordo
TRIPS, observando que, embora exista
uma vinculação histórica entre os direitos
de propriedade intelectual e os acordos
internacionais, o referido acordo surge com a
finalidade precípua de suprir, principalmente,
as deficiências relacionadas à proteção da
propriedade intelectual no âmbito mundial.
O trabalho tem como escopo analisar as
inovações trazidas através desse acordo ao
direito pátrio, essencialmente, no que diz
respeito à proteção da propriedade intelectual
e sua relação com o acesso dos indivíduos a
medicamentos. Para alcançar esse objetivo,
serão analisados os termos do acordo TRIPS,
em especial, as modificações exteriorizadas
por ele em relação às patentes na Indústria
Farmacêutica, assim como opiniões e decisões
da Organização Mundial do Comércio, da qual o
acordo faz parte, a fim de verificar a (in)eficácia
desses mecanismos em relação ao acesso de
medicamentos.

Abstract:
The purpose of this article is to
present the content of the TRIPS Agreement,
noting that, while there is a historical link between
intellectual property rights and international
agreements, this agreement arises primarily
to address deficiencies related to protection of
intellectual property worldwide. The purpose of
this study is to analyze the innovations brought
through this agreement to the mother country,
essentially, with regard to the protection of
intellectual property and its relation with the
access of individuals to medicines. In order to
achieve this objective, the terms of the TRIPS
agreement, in particular, the modifications made
by it in relation to patents in the Pharmaceutical
Industry, as well as the opinions and decisions
of the World Trade Organization, of which the
agreement is a part, will be analyzed in order
to to verify the (in) effectiveness of these
mechanisms in relation to drug access.
