AS DIFICULDADES NO ACESSO À MEDICAÇÃO PARA TRATAMENTO DO TDAH
O presente artigo tem como
objetivo analisar a relevância do fornecimento
de medicamentos pela rede do Sistema único
de Saúde (SUS) no que tange ao tratamento
do TDAH (Transtorno de Déficit de Atenção e
Hiperatividade), ressaltando a importância de
um tratamento eficaz e de qualidade, que tenha
como escopo aumentar a qualidade de vida não
só de quem está em tratamento, mas também
dos familiares e demais pessoa envolvidas.
Para tal, mister se faz compreender o que é
o TDAH, em que contexto histórico ele surgiu,
sua evolução, quais são os sintomas dessa
doença e as principais formas de tratamento
hoje utilizadas pelos profissionais da saúde.
Além disso, objetiva-se analisar se existe uma
obrigatoriedade do poder público em fornecer os
fármacos indicados para o tratamento do TDAH,
se eles constam nas listas oficiais do Ministério
da Saúde e se, de fato, existe essa dispensação
desses medicamentos pelos postos de saúde,
dentre outros estabelecimentos responsáveis.
Ainda, será feita uma análise jurisprudencial em
que serão estudados alguns casos concretos
de pessoas que sofrem do TDAH, porém não
possuem recursos financeiros para custear
o tratamento, e, por esse motivo, procuram o
Poder Judiciário para que este efetive seu
direito à saúde. Por fim, demonstra-se a clara
necessidade de se obter maior eficiência do
Sistema Público de Saúde, com o escopo de
garantir o direito fundamental à vida, à saúde,
além de respeitar o princípio da dignidade da
pessoa humana expressamente consagrado na
Constituição Federal como um dos fundamentos
da República Federativa do Brasil.

Abstract:
The purpose of this article is
to analyze the relevance of the provision of
medicines through the network of the Single
Health System (SUS) regarding the treatment
of Attention Deficit Hyperactivity Disorder (ADHD), emphasizing the importance of
effective and quality treatment, with a view to increase the quality of life not only of
those who are undergoing treatment, but family members and others involved. To do
this, it is necessary to understand what ADHD is, in what historical context it emerged,
its evolution, what are the symptoms of ADHD and the main forms of treatment used
today by health professionals. In addition, the objective is to analyze whether there is
an obligation on the public authority to provide the drugs indicated for the treatment of
ADHD, if they are on the official lists of the Ministry of Health and if, in fact, there is such a
dispensation of these drugs by health clinics, among other responsible establishments.
Furthermore, a case law will be studied in which some of the concrete cases, people
suffering from ADHD do not have the financial resources to pay for the treatment, and
for this reason, they seek the Judiciary Branch so that it can ensure the Right to Health.
Finally, there is a clear need to improve the efficiency of the Public Health System, with
the scope of guaranteeing the right fundamental to life, health, and respect the principle
of the dignity of the person expressly enshrined in the Federal Constitution as one of
the foundations of the Federative Republic of Brazil.
