AS DIFERENÇAS ENTRE BRASIL E ARGENTINA QUANTO À SUSCITAÇÃO PROCESSUAL DA PRESCRIÇÃO CIVIL
Trata-se de pesquisa sobre o regime jurídico civil e processual civil da Argentina e do Brasil quanto ao reconhecimento ou não da prescrição de pretensões civis ex officio pelo juiz. Tem por objetivo comparar a disciplina legal do ato processual de reconhecimento nos dois ordenamentos jurídicos e demonstrar em quais pontos se assemelham e se distinguem, para, ao final, concluir qual se apresenta mais condizente com a realidade processual do Brasil. Metodologicamente, a pesquisa utiliza de análise documental nos Códigos Civil e de Processo Civil do Brasil e da Argentina, análise de julgados argentinos que sejam paradigmas ou precedentes naquele país, análise de julgados posteriores a 2016 e revisão bibliográfica de amostras da literatura jurídica brasileira e argentina.

Abstract:
This is a research on the civil and procedural legal regime in Argentina and Brazil regarding the recognition or not of the prescription of civil claims ex officio by the judge. It aims to compare the legal discipline of the procedural act of recognition in the two legal systems and to demonstrate in which points they are similar and distinguished, in order, in the end, to conclude which one is more consistent with the procedural reality of Brazil. Methodologically, the research uses document analysis in the Civil and Civil Procedure Codes of Brazil and Argentina, analysis of Argentine courts that are paradigms or precedents in that country, analysis of courts after 2016 and bibliographic review of samples of Brazilian legal literature and Argentina.
