AS CONTRIBUIÇÕES DO
Correlacionando as obras Justiça Poética de Martha Nussbaum e as reflexões extraídas do conto Perdoando Deus de Clarice Lispector, este artigo intenta resgatar a ética humanística do ato de decidir a partir de uma reinterpretação dos princípios da imparcialidade e neutralidade dos juízos. A práxis da hermenêutica tradicional, influenciada pelos ideais socioideológicos do Aufklärung, ainda reproduzida, na contemporaneidade, é confrontada aos ensinamentos do poeta-juiz - atento às revoluções paradigmáticas da Filosofia da Linguagem e da Hermenêutica Filosófica no que tange à importância da historicidade, da tradição e da complexidade da vida - com vistas à construção de uma justificação racional e humanista para os processos decisórios na edificação de um Direito efetivamente democrático.

Abstract:
By correlating the work "Poetic Justice" by Martha Nussbaum with the reflections extracted from Clarice Lispector's short story"Forgiveness God", this article attempts to rescue the humanistic ethics of decision-making through a reinterpretation of the principles of impartiality and neutrality of judges. To do so, the praxis of traditional hermeneutics, influenced by the socio-ideological principles of the Aufklärung still reproduced in contemporary times, is confronted with the teachings of the judge as poet - which means the one who is attentive to the paradigmatic revolutions of the Philosophy of Language and Philosophical Hermeneutics with regard to the importance of historicity, tradition and the complexity of life. In doing so, this research aims to present a rational and humanistic justification for the decision-making process and to showcase its importance in the construction of an effectively democratic judicial system.
