APOSENTADORIA POR INCAPACIADE PERMANENTE E O INSS EM CONCEIÇÃO DO ARAGUAIA
Trazendo entendimento acerca da aposentadoria por invalidez, atualmente exposta na emenda constitucional nº103/2019 transformou a nomenclatura do benefício para aposentadoria por incapacidade permanente, trazendo ainda algumas mudanças como a concessão e o cálculo de alguns benefícios. A aposentadoria por incapacidade permanente é um benefício dado ao indivíduo que em razão de incapacidade para trabalhar e sendo assim impossível sua reabilitação e inverossímil sua subsistência. O órgão competente (INSS) será responsável por essa concessão através de exame médico-pericial que avaliará se as circunstancias são favoráveis aos requisitos legais impostos por legislação especifica. lembrando que o beneficiário tem a possibilidade de evoluir de benefício através da agravação da aposentadoria por incapacidade temporária. Vale ressaltar que o beneficiário terá que cumprir um período mínimo para ter o benefício concedido, chamado de carência, esses períodos não se elencam exclusivamente a aposentadoria por invalidez, mas também abrangem outros benefícios tendo um prazo determinado para cada um, em se tratando do material disposto, o período de carência exigido é de 12 contribuições mensais se for comum, se for em casos acidentários essa carência será isenta.

Abstract:
