APÓS A REFORMA DA CLT DE 2017, QUAL SERÁ O PAPEL DOS SINDICATOS E DA CLT NO BRASIL?
Este estudo tem por objetivo realizar uma análise prospectiva para verificar qual será o novo papel dos sindicatos no Brasil do Século XXI, após a reforma da CLT de 2017. Para isso, por meio de pesquisa bibliográfica, utilizando-se o método dedutivo, chega-se à conclusão que para os sindicatos realizarem eficazmente sua missão será preciso que se adote no país o princípio da unidade nacional sindical. Isso possibilitará o surgimento de grandes sindicatos a nível nacional, o que contribuirá para a estabilidade econômica, para o desenvolvimento, para redução da judicialização das relações de trabalho e para a paz social. A representação sindical não será mais aquela que apenas reivindica reajuste salarial e promove greves. O socialismo do início do Século passado que pregava o confronto da classe operária com a empresarial está em extinção e a sua influência no Brasil se dissipará como consequência da necessidade de novo posicionamento diante do tema. A mudança de comportamento dos sindicatos torna-se essencial para prover a eficiente representação de seus associados. A negociação coletiva ganhou muita importância com a última reforma da CLT. O governo federal deve ratificar a Convenção n. 87 da OIT e também propor o fim do princípio da unicidade sindical. A CLT paulatinamente está se transformando em marco regulatório e isso trará grandes benefícios para as negociações entre empregador e empregado, contribuindo para a dinâmica de mercado e para o desenvolvimento do país.

Abstract:
This study aims to carry out a prospective analysis to verify what will be the new role of unions in Brazil in the 21st century, after the 2017 CLT reform. For this, through bibliographic research, using the deductive method, it is concluded that for the unions to carry out their mission effectively, it will be necessary to adopt the principle of national unity in the country. This will enable the emergence of large unions at the national level, which will contribute to economic stability, development, reduced judicialization of labor relations and to social peace. Union representation will no longer be one that only claims salary increases and promotes strikes. The socialism of the beginning of the last century that preached the confrontation of the working class with the business class is extinct and its influence in Brazil will dissipate as a consequence of the need for a new position on the subject. The change in the behavior of unions is essential to provide efficient representation for their members. Collective bargaining gained a lot of importance with the last reform of the CLT. The federal government must ratify Convention no. 87 of the ILO and also propose the end of the principle of union unity. CLT is gradually becoming a regulatory framework and this will bring great benefits to the negotiations between employer and employee, contributing to the dynamics of the market and the development of the country.
