ANÁLISE DOS EFEITOS JURÍDICOS E SOCIAIS DOS PROJETOS DE LEI APRESENTADOS EM SANTA CATARINA CONTRA GRUPOS IDENTITÁRIOS TRANSGÊNEROS
: Vivência identitárias de gênero divergente daquelas ditas socialmente aceitas vem conquistando a base de lutas constantes seus direitos que são garantidos por lei constitucional. Entretanto indo na contramão da amplitude dos direitos o governo de Santa Catarina vem tomando medidas patologizadas e submetidas a preconceitos e discriminações que, no extremo, terminam com o assassinato de pessoas pelo fato de serem da população transgênico (transexuais e travestis), afigurando-se crimes de ódio em que as mulheres transexuais e as travestis são alvos recorrentes, repetindo o modelo da violência tradicional de gênero. Nessa conjuntura desumanizadora, desenvolve-se uma necessidade de repudiar esse atraso ideológico e incentivar o espaço necessário de reconhecimento de direito de pessoas transexuais e travestis ao gênero, independentemente do sexo biológico. O presente trabalho apresenta o panorama a nível catarinense e os efeitos que caso alvo nessa linha seja aprovada irão acarretar.

Abstract:
Gender identity experiences diverging from those said to be socially accepted have been conquering the basis of constant struggles for their rights, which are guaranteed by constitutional law. However, going against the breadth of rights, the government of Santa Catarina has been taking pathologized measures and subjected to prejudices and discrimination that, in the extreme, end with the murder of people because they are from the transgender population (transsexuals and transvestites), appearing to be hate crimes in which transgender women and transvestites are recurrent targets, repeating the model of traditional gender violence. In this dehumanizing situation, there is a need to repudiate this ideological backwardness and to encourage the necessary space for the recognition of the right of transsexuals and transvestites to gender, regardless of biological sex. The present work presents the panorama at Santa Catarina level and the effects that if target in this line is approved will cause.
