ANÁLISE DA AUTONOMIA DAS POPULAÇÕES TRADICIONAIS DE RESERVAS EXTRATIVISTAS NO USUFRUTO E ALIENAÇÃO DOS RECURSOS FLORESTAIS (MADEIREIROS E NÃO MADEIREIROS) EM SEUS TERRITÓRIOS
Pesquisa a autonomia dos povos e comunidades tradicionais de Reservas Extrativistas Federais (Resex) na exploração dos recursos naturais, madeireiros e não madeireiros de acordo com o Sistema Nacional de Unidades de Conservação (SNUC), Lei nº 9.985 de 2000. Analisa-se os marcos legislativos que asseguram os direitos à territorialidade e tradicionalidade das populações tradicionais, como o Decreto 6.040 de 2007 e a Convenção nº 169 da Organização Internacional do Trabalho (OIT). Nas Resex diferentes mecanismos atuam sobre a autonomia das comunidades tradicionais, evidenciando os diversificados modelos de intervenção nessas áreas de uso comum. A autonomia é relativa e relativizada com as ações e interesses do gestor da Unidade de Conservação, que não é um morador da Resex, mas um funcionário público. É previsível, portanto, que surjam conflitos decorrentes das condutas exploratórias das populações tradicionais e a interpretação da administração sobre os limites legalmente estabelecidos para uso das áreas. A gestão deixa de ser exclusiva das populações tradicionais e passa a ser também do órgão ambiental, representado pelo Instituto Chico Mendes de Conservação da Biodiversidade (ICMBio). Com exceção das atividades de mineração, as demais restrições impostas às comunidades extrativistas destoam dos princípios constitucionais que asseguram seus modos de criar, fazer e viver, fundamentados nos art. 215, § 1.º e caput do art. 216 da Constituição Federal de 1988. É imprescindível que as ações do Poder Público respeitem a autonomia decisória desses povos e garantam maior equidade e justiça nos assuntos que os envolvam para que seus direitos não sejam silenciados pela gestão estatal.

Abstract:
The research is about the autonomy in the exploration of natural resources, that includes timber and non-timber resources, for de traditional peoples and communities who live in Federal Extractive Reserves (RESEX), which is regulated by the National System of Protected Areas, Law no. 9.985/2000. Also analyses the legislative landmarks that ensure the rights about the territoriality and traditionality of the traditional communities, as the Decree no. 6.040 and the Convention no. 169 of International Labour Organization (ILO). In the RESEX, several mechanisms act on the autonomy of the traditional communities, showing diversified models of intervention in these common use areas. The autonomy is relative and relativized with the actions and manager´s interests of conservation units, who is not a RESEX´s resident, but a public employee. Therefore, is predictable the emergence of conflicts arising from exploratory conducts by the traditional communities, and administrative interpretation about the legal limits for the use of areas. Thus, the management is not exclusive of the traditional communities, but too of the environmental agency, represented by the Chico Mendes Institute for Biodiversity Conservation (ICMBio). Except by the mining activities, the others restrictions imposed on extractive communities disrupt of the constitutional principles, which ensure way of making, doing and live, based in the articles 215, § 1.º and caput of 216 of the 1988 Federal Constitution. Is necessary that the Public Power’s actions respect the decision-making autonomy of these peoples, and guaranteethe equity and justice in the subjects that involve them, for the state management does not silence their rights.
