Abstract: In this paper, we sought to examine the coherence of the arguments related to the intellectual and socio-emotional development of adolescents as a justification for lowering the age of criminal majority. 59 Proposals for Amendments to the Constitution were analyzed, which were processed in the National Congress from 1989 to 2015, on the subject. Of these, 52 used the argument that adolescents would be mature enough to discern right and wrong in their behavior and, consequently, be judged and punished as adults by the criminal justice system. However, national and international scientific evidence on cognitive and psychosocial development indicates that, although 16-year-old adolescents and younger have logical reasoning skills similar to adults, the same does not happen in terms of decision-making, especially in situations marked by emotional tension, peer influence and future projection on the consequences of their actions. In conclusion, these allegations presented by the parliamentarians lack empirical foundation and, therefore, must be refuted.
