ANÁLISE CRÍTICA DA NATUREZA JURÍDICA DO MICROEMPREENDEDOR INDIVIDUAL (MEI)
: Essa pesquisa tem como conjuntura histórica a complexificação do mundo do trabalho, apontando o microempreendedor individual (MEI) como uma das novas formas de trabalho. Detecta os limites encontrados no sistema jurídico brasileiro para a configuração dessa modalidade de trabalho, analisando a natureza jurídica do microempreendedor individual como empresário individual. A sua pergunta central é: o MEI preenche os requisitos de equiparação ao empresário individual? Para respondê-la, a pesquisa tenciona cada um dos elementos caracterizadores do empresário individual para verificar o rigor dessa equiparação. A pesquisa possui uma abordagem crítica, utilizando como fonte dos dados uma pesquisa bibliográfica, a legislação nacional e bases de dados oficiais. Conclui apontando a necessidade de alteração legislativa para atendimento das particularidades do MEI e da ampliação da proteção a esses trabalhadores.

Abstract:
This research has as a historical conjuncture the complexification of the world of labor, pointing the individual microentrepreneur (MEI) as one of the new forms of work. It detects the limits found in the Brazilian judicial system for the configuration of this work modality, analyzing the legal nature of the individual microentrepreneur as an individual entrepreneur. Its central question is: does the individual microentrepreneur fulfill the requirements for an equiparation to the individual entrepreneur? To answer this, the research tenses each of the characterizing elements of the individual microentrepreneur to verify the rigor of this equiparation. The research has a critical approach, using as a data source bibliographical research, the national legislation, and official databases. It concludes by pointing out the necessity of legislative modifications to attend to the individual microentrepreneur's particularities and to amplify these workers' protection.
