Abstract: This study sought to reflect on the school inclusion of students with Autism Spectrum Disorder (ASD), based on Opinion CNE/CP No. 50/2023 issued by the Brazilian National Council of Education (CNE), which provides specific guidelines for special education, particularly regarding students with ASD. The opinion was approved in December 2023, following a reassessment conducted by the Bicameral Commission on Special Education, prompted by public mobilizations opposing the original version of the document, which posed a threat to the rights guaranteed to persons with disabilities. In response to the need for improvement, the document underwent revision, incorporating legal references such as the 1988 Federal Constitution, the National Education Guidelines and Framework Law (LDB), and Law No. 12,764/2012, which established the National Policy for the Protection of the Rights of Persons with ASD. To address this issue, documentary research was conducted based on Gil (2008) and Lakatos and Marconi (2003), along with a literature review drawing on authors such as Mantoan (2006), Oliveira (2016), Mittler (2003), and Costa, Schmidt, and Camargo (2023). The analysis revealed gaps in the document, including the lack of a clear definition of the role of support professionals, uncertainties regarding the Individualized Education Plan (IEP), the absence of evidence-based pedagogical practices, and insufficient provision for teachers' continuing professional development. Despite normative advances, many children and adolescents with ASD remain integrated into schools but are not fully included, due to the inadequacy of school practices. Opinion No. 50/2023 demonstrates that the rights guaranteed by law have not yet been fully implemented.
