ALTERAÇÕES INTRODUZIDAS NO CÓDIGO PENAL A PARTIR DA LEI 13.104/15: O FEMINICÍDIO NO ROL DOS CRIMES HEDIONDOS
O presente artigo, analisa as
alterações realizadas no Código Penal (Lei
2.848 de 7 de dezembro de 1940) em seu
artigo 121 e na lei 8.072 de 25 de julho de
1990, a Lei de Crimes Hediondos por meio
da criação da Lei 13.104 (Lei do Feminicídio)
de 09 de março de 2015. Esta inovação
legislativa prevê uma tipicidade de homicídio
qualificado, incluindo para o rol dos crimes
hediondos a morte da mulher em razão da
condição do sexo feminino, tendo em vista o
avanço e as modificações vivenciadas pela
sociedade, repercutindo no cenário normativo.
O artigo foi elaborado a partir da pesquisa
bibliográfica, com consulta a textos de referência
para a temática e à legislação vigente, para
isso, primeiro analisou-se a histórica relação
de poder, submissão e inferiorização da mulher
o que contribuiu para perpetuar o crescente
fenômeno da violência contra a mulher e sua
morte, e posteriormente examinou-se as
alterações no artigo 121 do Código Penal para
inserir o Feminicídio e as características desta
nova figura criminosa que constitui a ultima
instância de controle sobre a vida ou morte da
mulher e a evolução da legislação que trata
da proteção dos direitos da mulher a qual tem
papel elementar na formação da sociedade.

Abstract:
This article analyzes the changes
made in the Criminal Code (Law 2,848 of
December 7, 1940) in its article 121 and in
Law 8,072 of July 25, 1990, the Law of Harmful
Crimes through the creation of Law 13.104
(Law of the Feminicide) of March 9, 2015. This
legislative innovation provides for a typicity of
qualified homicide, including for the role of
heinous crimes the death of the woman because
of the female condition, in view of the progress
and changes experienced by society , affecting
the normative scenario.
The article was elaborated from the bibliographical research, with reference to reference
texts for the thematic and the current legislation. For this, first the historical relation of
power, submission and inferiorization of the woman was first analyzed, what contributed
to perpetuate the growing phenomenon violence against women and their death, and
subsequently examined the changes in article 121 of the Criminal Code to insert the
Feminicide and the characteristics of this new criminal figure that constitutes the last
instance of control over the life or death of women and the evolution of the legislation
that deals with the protection of the rights of women, which plays an elementary role in
the formation of society.
