O objetivo geral do trabalho é analisar

o panorama do uso de agrotóxicos no Brasil

e suas violações aos direitos fundamentais,

demonstrando a visível inconstitucionalidade

e a consequente insegurança gerada ao

ordenamento jurídico. A metodologia do

presente trabalho foi bibliográfica, documental e

jurisprudencial. Em um estudo com perspectiva

do Direito Constitucional e Ambiental, notase

que uso de agrotóxicos viola de preceitos

constitucionais fundamentais coexistentes na

Carta Magna, como a proteção dos direitos

à saúde, ao meio ambiente e trabalhista que

é atribuída ao Estado, além da seguridade

da Dignidade da Pessoa Humana, preceito

basilar em um Estado Democrático de Direito,

colocando o poder estatal em uma condição de

negligência ao ignorar uso indiscriminado de

agrotóxico e sua não fiscalização.

Abstract:
The general objective of this

work is to analyze the panorama of the use of

agrochemicals in Brazil and their violations of

fundamental rights, demonstrating the visible

unconstitutionality and the resulting insecurity

generated by the legal system. The methodology

of the present work was bibliographical,

documentary and jurisprudential. In a study with a

perspective of Constitutional and Environmental

Law, it is noted that the use of agrochemicals

violates fundamental constitutional precepts

coexisting in the Federal Constitution, such as

the protection of rights to health, the environment

and labor rights, which are attributed to the State,

in addition to the security of the Dignity of the

Human Person, a basic precept in a Democratic

State of Law, placing state power in a negligent

condition by ignoring the indiscriminate use of pesticides and their non-enforcement.
