AÇÕES COLETIVAS X AÇÕES INDIVIDUAIS: ANÁLISE COMPARATIVA DOS RESULTADOS ALCANÇADOS E QUAL O MELHOR CAMINHO PARA DEFENDER OS ATINGIDOS POR GRANDES CATÁSTROFE
A história lida com grandes tragédias no país, dentre elas o caso da Boate Kiss em Santa Maria/RS o qual teve como resultantes 241 óbitos e 623 feridos, o rompimento da barragem de Mariana tendo como resultantes 19 óbitos e vilarejos inteiros arrasados com impactos socioambientais registrados em Minas Gerais e no Espírito Santo. Mais recente a tragédia de Brumadinho que ocasionou, até então, 249 óbitos, sendo que, 06 pessoas seguem desaparecidas e o incêndio no centro de treinamento Ninho do Urubu do Clube de Regatas do Flamengo no Rio de Janeiro que culminou no óbito de 10 rapazes engrossam as estáticas das demandas coletivas. Tais situações mexeram com o mundo jurídico resultando em nova enxurrada de processos, e assim, urge a necessidade de estudos mais aprofundados sobre a aplicabilidade dos institutos da ação coletiva e do Incidente de Resolução de Demandas Repetitivas em detrimento das ações individuais com o objetivo de nortear qual o melhor caminho.

Abstract:
The History deals with major tragedies in the country, including the case of the Kiss Club in Santa Maria / RS which resulted in 241 deaths and 623 injuries, the Mariana dam rupture resulting in 19 deaths and entire villages devastated with socio-environmental impacts in Minas Gerais and Espírito Santo. More recently the Brumadinho tragedy that has so far caused 249 deaths, 21 people are still missing and the fire in the training center of the Flamengo Regatta Club in Rio de Janeiro that resulted in the death of 10 boys thickens the static of collective demands. Such situations have affected the legal world resulting in a new flood of lawsuits, and thus, the need for further studies on the applicability of the institutes of collective action and the Repetitive Demand Resolution Incident to the detriment of individual actions in order to guide what is the best way.
