Abstract: This work, the result of a literature review, addresses the right to education in Brazil, with an emphasis on access to and retention in higher education, as established in the Federal Constitution of 1988 and the Law of Guidelines and Bases of Education (LDB/1996). The objective of this study was to reflect on the right to education, access to and retention in higher education, as well as to provide a conceptual analysis of these terms. It was concluded that, although education is a social right guaranteed by law, access to higher education still faces barriers, especially for low-income students, due to social, economic, and cultural inequalities. The expansion of higher education, mainly through private initiatives, increased the number of available spots but did not, by itself, ensure student retention. Retention is understood as the continuity and completion of studies, making the creation of public policies that offer material, symbolic, and pedagogical support to students in vulnerable situations essential. Thus, the text argues that access and retention must be understood in an integrated manner, and that it is the State’s responsibility to guarantee the real conditions for the fulfillment of this right, promoting equal opportunities in higher education.
