ACESSO À JUSTIÇA E A RECOMENDAÇÃO DE PROVIDÊNCIAS PRÉVIAS NAS AÇÕES RELATIVAS AO FORNECIMENTO DE MEDICAMENTO
Buscou-se averiguar se há ofensa ou não ao princípio do acesso à justiça diante da recomendação de existência de documentação prévia para a propositura de ação relativas ao fornecimento de medicamentos. Analisou-se a Recomendação n. 1/14 do Juizado Especial Cível da Comarca de Leme e as decisões proferidas pelo juízo no intervalo de um ano. Conclui-se que, na Comarca em questão, a existência da Recomendação não prejudicou o acesso à justiça das partes que dela precisaram, pois, das 38 sentenças proferidas para fornecimento de medicamentos, em 37 delas o fornecimento delas foi concedido. Foi utilizado método dedutivo.

Abstract:
I looked forward to observing whether or not there is a break in the principle of justice access whenever it is reccomended previous documents to ask for law suits related to medicine supply. We analized Recomendação n. 1/14 from Juizado Especial Cível da Comarca de Leme and the decisions made by the Court in a whole yeartime period. We concluded, in the court analized, the existance of Recomendação did not hurt the access to justice from the ones who needed it, because there were 38 judgements made about medicine, and 37 of them received it fully. The system was deductive.
