A VULNERABILIDADE DOS ENTREGADORES DE DELIVERYS POR APLICATIVOS E CONTRADIÇÕES A LUZ DAS LEIS TRABALHISTAS
Este artigo visa problematizar sobre a nova forma de trabalho surgido através de aplicativos de delivery, focando na vulnerabilidade do entregador e mostrando as contradições desse tipo de emprego em relação as normas trabalhistas e a constituição federal, bem como apresentando os principais fatores do expoente crescimento da adesão desses aplicativos de delivery no mundo capitalista contemporâneo. Partindo da perspectiva da atual conjuntura capitalista e da apreciação das leis trabalhistas, doutrina e da magna carta brasileira, os pontos suscitados nesta abordagem são de natureza qualitativa, atravessando a perspectiva analítica do direito na relação trabalhista a ser estudada, bem como da sociologia no cenário capitalista. Por meio dessa análise é possível deixar claro alguns direitos trabalhistas assegurados pelo direito brasileiro e para fomentar as discussões se utilizara de um estudo sobre as mudanças de forma de trabalho. O trabalho a ser estudado tem por objetivo de promover o debate acerca dos novos modelos de trabalho pelos aplicativos de envio de comida, e de dialogar a respeito das condições submetidas a esse tipo de trabalhador no mundo capitalista competitivo.

Abstract:
This article aims to discuss the new form of work that emerged through delivery applicatives, focusing on the vulnerability of the delivery person and showing the contradictions of this type of employment in relation to labor standards and the federal constitution, as well as presenting the main factors of the exponential growth of the adhesion of these delivery applicatives in the contemporary capitalist world. Starting from the perspective of the current capitalist situation and the appreciation of Brazilian labor laws, doctrine and the great letter, the points raised in this approach are of a qualitative nature, crossing the analytical perspective of the law in the labor relationship to be studied, as well as sociology in the scenario capitalist. Through this analysis, it is possible to make clear some labor rights guaranteed by Brazilian law and to encourage discussions, a study on changes in the way of working was used. The work to be studied has the objective of promoting the debate about the new models of work by the applications of food delivery, and to dialogue about the conditions submitted to this type of worker in the competitive capitalist world.
