Abstract: This paper examines the role of the criminal victim as a procedural witness, specifically when they fail to comply with a court order, in accordance with articles 201, 218, and 219 of the Brazilian Code of Criminal Procedure (CPP). The article compares two dissenting views, weighing the state interest against the potential for further victimization of the already shaken passive subject of the crime. The article uses theoretical research, compiling and reviewing qualitative bibliographic data with a normative approach to the legal provisions. It was ultimately determined that requiring the cooperation of a crime victim in the legal process should be an exception, only justifiable in specific cases. This ensures that the legal system does not ignore the victim's rights and re-victimize them as a standard practice.
