Abstract: This paper aims to analyze the relationship between truth and penal garantism based on pages 48 to 68 of the book Law and Reason: Theory of Penal Garantism by Luigi Ferrajoli. The author proposes a normative and procedural conception of truth, distancing himself from both judicial decisionism and the illusion of a substantive truth obtained at any cost. According to Ferrajoli, truth in criminal proceedings is neither absolute nor metaphysical, but rather regulated—produced within strict legal limits and constitutional safeguards. The study shows that truth, understood as the correspondence between facts and the judicial decision, constitutes not only an epistemic value but also a political one, insofar as it serves as a prerequisite for the legitimacy of state punitive power. From this perspective, the paper also discusses the role of guarantees as mechanisms to prevent judicial error and as instruments to ensure the rationality and fairness of criminal decisions.
