A Valoração do Dano Moral no IRDR 040/2016
O presente trabalho versa sobre a fixação do quantum indenizatório no IRDR 040/2016 que julgou as demandas repetitivas envolvendo os pleitos de danos morais face as empresas Samarco Mineração S/A, Vale S/A e BHP Billiton Brasil, oriundos da interrupção do abastecimento de água na cidade espírito-santenses banhadas pelo rio Doce, após o rompimento da barragem de Fundão-MG. É posto em pauta se o instituto jurídico utilizado é via apta para a fixação do montante indenizatório, ou se tal juízo deve ser realizado exclusivamente por ação individual. Em conseguinte, analisa-se a possibilidade de os juízes de piso (vinculados ao julgamento proferido em sede do Incidente de Resolução), deferirem o pagamento de quantia diversa a título de reparação de danos.

Abstract:
The present work debates about the indemnity quantum in the Repetitive Claims Resolution Incident 040/2016, which judged the repetitive claims involving the demands of pain and suffering against the companies Samarco Mineração S/A, Vale S/A and BHP Billiton Brasil, arising from the interruption of the water supply in the cities located in the state of Espírito Santo that are crossed by the Doce river, after the rupture of the Fundão’s city dam. It is discussed whether the legal institute used is suitable for setting the indemnity amount, whereas that judgment must happen exclusively on the individual actions. Consequently, it is also considered if the judges of the Civil Courts (who are bound to the merit decided in the Resolution Incident) can grant a different indemnity amount in answer to the alleged pain and suffering required in those individual claims.
